TRAI directs five big MSOs to provide compliance report in seven days
MUMBAI: Telecom Regulatory Authority of India (TRAI) has ticked off five multi system operators (MSOs) for non-adherence to the new regulatory framework and has directed them to provide compliance report within seven days.
The regulator has issued the directions to Hathway Digital, DEN Networks, Siti Networks, GTPL Hathway and IndusInd Media and Communications Ltd (IMCL) for not complying with different provisions of the regulations and quality of service norms.
The non-compliance of the MSOs came to light after the TRAI through BECIL carried out audit inspection of the headend, conditional access system (CAS), subscriber management system (SMS) and the network system.
In June, the TRAI had directed the MSOs to submit the compliance to the shortcomings/discrepancies noticed during the audit within fifteen days of the issue of the letter. On scrutiny of the reply received from the MSOs, the TRAI found that they still do not comply with the New Regulatory Framework, 2017 on various points.
Some of the common non-compliances of the MSOs include LCOs without GST Registration collecting tax amount from the subscribers but not depositing it. Another common non-compliance is that the LCOs are not providing itemised invoices to the consumers. Some LCOs are providing their own Cash memo bills.
Hathway Digital was found to be not complying on two counts. The facility of bill generation is available in LCO portal, but the customers are not able to get itemised billing in most cases even after the request of the subscriber. Secondly, the LCOs without GST Registration are collecting tax amount from the subscribers but not depositing it.
In case of DEN Networks, LCOs are providing their own cash memo bills using a card system for payment receipts, while the subscribers are not able to get itemised bills. Secondly, the facility of upgradation and modification in the subscription is not available on the Consumer portal.
IMCL has been pulled up as its consumer portal is not working. IVRS facility of IMCL does not have any provision for complaint registration. LCOs without GST Registration are collecting tax amount from the subscribers but not depositing it. Also, LCOs are not providing the itemised invoices to the consumers.
According to the TRAI direction, Siti Networks’ LCOs can provide itemised invoices to consumers but most of the LCOs are not providing the same. Some LCOs are providing their own cash memo bills. IVRS facility of Siti Networks does not have any provision for complaint registration.
The TRAI director noted that the IVRS facility of GTPL Hathway does not have provision for complaint registration. The consumer portal of Mj s GTPL KCBPL has very limited facilities. The facility of up-gradation and modifications in the subscription is not available on the consumer portal. LCOs without GST Registration are collecting tax amount from the subscribers but not depositing it.
