Novex gets injunction from Bombay HC to prevent music piracy by hotels, establishments

MUMBAI: In a pre-emptive move to prevent piracy of its music catalogue, music rights company Novex Communications has got an injunction from the Hon’ble Bombay High Court against hotels and other establishments across India.

Novex is the exclusive assignee of the on ground performance rights of Zee Entertainment Enterprises Ltd, Tips Industries Limited and Eros International Media in addition to being the exclusive authorised agent of Yash Raj Films.

Justice S. J. Kathawalla granted an Injunction restraining several leading hotels from the public performance of copyrighted music without obtaining the appropriate license from the Copyright holder. This assumes significance as Christmas and New Year Parties are on the anvil and several hotels hold celebrity events where popular music is played, without any license for public performance of music.

The hotels/establishments against whom the injunction has been granted by the Bombay High Court include Tap Resto Bar, Bora Bora, Caravan Seria, Hometown Cafe, Red Box Cafe, Global Fusion, Chinagate restaurants, Matahaari, Andheri Recreation club, Cricket Club of India, Peninsula Grand Hotel Mumbai, Daffodils 23 – Zinc Lounge & Kitchen Mumbai, Majestic Court Sarovar Portico Mumbai, Kenilworth Goa and Kolkata, The Regenza by Tunga Mumbai, The Golden Days Club Jaipur, Marriott Jaipur, Resort Rio Goa, Park Regis Goa, Casino Maharaja Goa, Crown Plaza Kochi and Radisson Blu Plaza Hotel Mysore.

These hotels/establishments will now have to pay Novex to secure the rights for playing songs that are part of its catalogue. Playing or allowing playing of music or any other sound recording for public performance without the permission of the copyright holder will amount to infringement and contravention of the Copyright Act.

“All the above mention hotels/establishments are restrained from utilizing and/or playing the sound recording in which Novex has on ground public performance right if they do not obtain necessary non-exclusive public performance rights in sound recordings from Novex. It is expected that Hotels will now comply with the rigours of Law as otherwise, they will be exposing themselves to action for Contempt of Court as they have been put on Notice of the Court Orders,” Novex said in a statement.

The further also said that esteemed hotel chains such as Taj, ITC, Oberoi & Trident Hotels, Sun and Sand, Club Mahindra, most of the Marriot Hotels, The Park, The Leela, The Lalit, and most of the Hyatt Hotels among others have obtained public performance rights of its songs for playing them during the New Year events as well as for year-round events.

The company urged all the restaurant/hotels/pubs/lounges and such other event venues to obtain necessary non-exclusive public performance rights in sound recordings to avoid any kind of litigation for such alleged infringements of our Copyright.
