Coronavirus: TDSAT to list only fresh, part-heard matters from 17 March till 1 April

MUMBAI: The Telecom Disputes Settlement and Appellate Tribunal (TDSAT) in consultation with Telecom Lawyers’ Association (TLA) has decided that there will be no listing of any matter before the tribunal from 17th March till 1st April except fresh matters listed on 17.03.2020 and part-heard matters, if any.

All Advocates and litigants are advised not to visit TDSAT except for the aforesaid urgent matters. All the concerned persons are requested to cooperate.

In view of the advisory issued by the Ministry of Health & Family Welfare, Government of India, vide OM dated 5th March 2020 regarding the spread of COVID-19 as global pandemic advising against the mass congregation, TDSAT chairperson has convened a meeting with the Telecom Lawyers’ Association (TLA).

Further, the TDSAT has decided that the counsel for the parties whose matters are listed before the tribunal between 17.03.2020 to 01.04.2020 may obtain a convenient date of listing of the matter from Mr. D.B. Chetri over the telephone (Mob. No.9560411677).

During the said period there shall be a limitation on the appearance of the Advocates i.e. only one arguing Advocate accompanied with a maximum of one more person, if any, from each side shall be allowed entry in the Court Room.

All existing interim orders expiring during the said period of 17.03.2020 to 01.04.2020 shall stand extended till 01.04.2020. During the said period, there shall be no filing of any pleadings including fresh matters/applications etc. except urgent matters.

For filing and listing of urgent matters/applications etc., if any, during the said period, the concerned Advocate/Party shall contact Mr. Sanjeev Pandey, Deputy Registrar over the telephone (Mob. No.9968072865).

The Deputy Registrar shall decide the urgency and intimate his decision to the concerned Advocate/Party. In matters where the Deputy Registrar feels appropriate, he may, in his discretion, consult with the Hon’ble Chairperson and thereafter intimate the concerned person about the decision.

It has also been decided that there shall be no listing of matter before the Registrar Court and Mediation Centre of TDSAT during the said period. Parties who were given time to file the pleadings during the said period, the time for filing of the same stands extended till 01.04.2020.

The tribunal will hold a review meeting on 1st April 2020 at 12:30 pm.
